America First Policy Institute Supports President Trump in Supreme Court Tariff Authority Case

Washington, D.C.—Today, the America First Policy Institute (AFPI) released a statement in support of President Donald J. Trump in Learning Resources, Inc. v. Trump. The case, argued today before the U.S. Supreme Court, challenges the tariff authority exercised during his administration.

The amicus brief filed by AFPI explains that Congress expressly granted the President broad discretion to regulate imports under the International Emergency Economic Powers Act (IEEPA). The full brief is available here.

“The authority to safeguard America’s workers and national security through lawful tariff action is essential,” said Jill Homan, AFPI Deputy Director of Trade & Economy Policy. “President Trump’s use of tariffs has proven to be an effective tool for countering unfair trade practices and restoring American strength. The Supreme Court should uphold this authority and protect the ability of the President to respond rapidly to economic threats.”

The amicus brief also explains that the power granted to the President by Congress to regulate imports has always included the ability to impose tariffs.

“This case goes to the heart of America’s economic sovereignty,” said Brian Kelsey, AFPI Senior Attorney of Litigation. “Tariffs have historically been one of America’s most powerful tools to deter economic aggression. The Court should recognize that the President acted squarely within his authority and that preserving this power is crucial to protecting American workers, supply chains, and long-term prosperity.”
